Babysitter Terms of Use

Article 1 (Purpose)

These Terms of Use set out the conditions for babysitters who register with Rainbow Kids Care and provide services through our platform.

Babysitters are independent service providers who have entered into an independent contractor agreement with Rainbow Kids Care. Babysitters are not employees of Rainbow Kids Care.

Babysitters agree to provide childcare services safely, responsibly, and in accordance with these Terms and the rules set by Rainbow Kids Care.

Article 2 (Definitions)

In these Terms, the following words have the meanings below:

(1) “Service” means the babysitting coordination and booking service provided by Rainbow Kids Care.

(2) “Client” means a person who requests babysitting services through Rainbow Kids Care.

(3) “Applicant” means a person who applies to register as a babysitter with Rainbow Kids Care.

(4) “Babysitter” means a person who has been approved by Rainbow Kids Care and provides childcare services upon request from Rainbow Kids Care.

(5) “Child” means a minor who is cared for through the Service under the responsibility of the Client.

Article 3 (Babysitter Registration)

Applicants must apply for registration by submitting the information and documents requested by Rainbow Kids Care.

Rainbow Kids Care will review the submitted information and documents and may conduct interviews or other screening procedures before approving registration.

Until registration is approved, the Applicant’s information will not be made available to Clients, and the Applicant may not provide babysitting services through Rainbow Kids Care.

Article 4 (Registration Requirements and Required Documents)

Rainbow Kids Care may approve an Applicant as a Babysitter only if the Applicant meets the following requirements:

(1) Is at least 18 years old

(2) Is legally permitted to work in Japan

(3) Is considered by Rainbow Kids Care to be capable of providing safe and appropriate childcare

(4) Has submitted valid identification documents

(5) Has submitted proof of notification or registration with the relevant prefectural or local authority, if applicable

(6) Has submitted documents proving relevant qualifications, if such qualifications are listed or claimed

(7) Has submitted proof of completion of training conducted by a prefectural governor or equivalent authority, if applicable

(8) Has submitted a declaration confirming that they have not received a business suspension order or similar administrative order

(9) Cooperates with interviews, explanations, and verification procedures conducted by Rainbow Kids Care

(10) Agrees to these Terms and all rules set by Rainbow Kids Care

Rainbow Kids Care will not approve registration for anyone who has not completed the required notification or registration, has not submitted required documents, or is considered unsuitable by Rainbow Kids Care.

Article 5 (Screening Before and After Registration)

Rainbow Kids Care conducts interviews, document checks, and suitability reviews before approving babysitter registration.

If Rainbow Kids Care determines that an Applicant is not suitable to provide babysitting services, registration may be refused.

After registration, Rainbow Kids Care may periodically review each Babysitter’s activity status, training status, submitted documents, and other necessary information.

Article 6 (Training Status)

Rainbow Kids Care may check each Babysitter’s training status and display or explain such status to Clients in an easy-to-understand way.

Babysitters without relevant childcare qualifications must complete training conducted by a prefectural governor or equivalent authority before providing services.

Rainbow Kids Care may guide Babysitters who have not completed required training to take the necessary training and may check their progress.

Article 7 (Changes to Registered Information)

Babysitters must promptly notify Rainbow Kids Care of any changes to the information or documents submitted at the time of registration.

If a Babysitter fails to report changes and this causes damage or trouble to Rainbow Kids Care, a Client, a Child, or a third party, the Babysitter will be responsible for handling the matter.

Article 8 (Refusal, Suspension, or Cancellation of Registration)

Rainbow Kids Care may refuse registration, suspend activity, cancel registration, or take other necessary measures if an Applicant or Babysitter falls under any of the following:

(1) Does not meet the registration requirements

(2) Provides false, incomplete, or inaccurate information or documents

(3) Has not completed the required notification or registration with the relevant authority

(4) Cannot provide required proof of identity, qualifications, training, or notification

(5) Has received a business suspension order or similar administrative order

(6) Is considered unsuitable for ensuring the safety of children

(7) Acts inappropriately toward a Client, Child, Rainbow Kids Care, or any third party

(8) Does not respond to requests or communications from Rainbow Kids Care within a reasonable period

(9) Violates these Terms or any rules set by Rainbow Kids Care

(10) Is otherwise considered unsuitable by Rainbow Kids Care

Rainbow Kids Care is not required to disclose detailed reasons for refusing, suspending, or cancelling registration.

Article 9 (No Duplicate Registration)

Babysitters may not register more than once using multiple names, email addresses, accounts, or other methods.

Article 10 (Basic Duties of Babysitters)

Babysitters must comply with the following:

(1) Prioritize the safety of the Child at all times

(2) Provide childcare with reasonable care and responsibility

(3) Review the Child’s health condition, allergies, personality, and any special instructions shared by the Client

(4) Follow the childcare details, time, location, and instructions shared by Rainbow Kids Care and the Client

(5) Comply with applicable laws, guidelines, and rules set by Rainbow Kids Care

(6) Supervise the Child carefully during the service

(7) Report the Child’s condition during or after the service when necessary

(8) Contact the Client and Rainbow Kids Care promptly in case of emergency and take appropriate action

Article 11 (Pre-Service Confirmation)

Before starting childcare, Babysitters should confirm the following as needed:

(1) Childcare location and meeting point

(2) Child handover method

(3) Emergency contact information

(4) Child’s health condition, allergies, medical conditions, and special instructions

(5) What to do in case of accident, illness, disaster, or other emergency

(6) Whether outings, pick-up/drop-off, meals, bathing, bedtime, or other care activities are included

Rainbow Kids Care checks each Babysitter’s identity, qualifications, and training status. However, if requested by the Client, the Babysitter must provide or explain, within a reasonable scope, their identification, notification or registration status, qualifications, and training status.

Article 12 (Reports During Childcare)

If requested by the Client, the Babysitter must provide reasonable updates about the Child’s condition during the service, where possible.

Article 13 (Emergency Response)

If the Child becomes ill, is injured, is involved in an accident, or another emergency occurs, the Babysitter must promptly contact the Client and Rainbow Kids Care.

When necessary, the Babysitter may take actions to protect the Child’s life and safety, including calling an ambulance, contacting a medical institution, or evacuating to a safe location.

If an accident or serious issue occurs, the Babysitter must promptly report the situation and response details to Rainbow Kids Care. Rainbow Kids Care may report the matter to the relevant authorities if necessary.

Article 14 (Post-Service Report)

At the end of the service, the Babysitter must report to the Client about the Child’s condition and relevant care details, such as meals, sleep, bathroom use, health condition, injuries, or any other important matters.

Article 15 (Prohibited Conduct)

Babysitters must not engage in any of the following:

(1) Enter into direct agreements or direct negotiations with Clients outside Rainbow Kids Care

(2) Register using multiple accounts or false information

(3) Place a Child in a dangerous situation

(4) Use abusive, violent, threatening, discriminatory, or harassing behavior toward a Client, Child, or third party

(5) Use, post, or share personal information, photos, or videos of a Client or Child without permission

(6) Fail to properly supervise the Child during the service

(7) Change the childcare location, service details, or end time without permission from Rainbow Kids Care or the Client

(8) Cancel a confirmed assignment without a valid reason

(9) Violate laws or public order and morals

(10) Damage the reputation of Rainbow Kids Care, Clients, other Babysitters, or third parties

(11) Engage in any other conduct that Rainbow Kids Care considers inappropriate

Article 16 (No Direct Contracts)

Babysitters may not provide services directly to Clients introduced through Rainbow Kids Care without going through Rainbow Kids Care.

If a Babysitter violates this rule, Rainbow Kids Care may cancel the Babysitter’s registration, claim damages, or take other necessary measures.

Article 17 (Personal Information and Confidentiality)

Babysitters must properly manage all information learned through the Service, including information about Clients, Children, family members, accommodation, booking details, and other private matters.

Babysitters may not use such information for any purpose other than providing the service, and may not disclose, leak, post, or share such information with third parties without prior permission from the Client or Rainbow Kids Care.

This does not apply where disclosure is required by law, necessary to protect life or safety, or considered necessary by Rainbow Kids Care.

Article 18 (Reviews and Information Sharing)

Rainbow Kids Care may interview Babysitters and Clients to check whether reviews reflect the actual service.

If a review is inaccurate, misleading, inappropriate, or unsuitable for publication, Rainbow Kids Care may edit, hide, or remove the review.

If Rainbow Kids Care becomes aware of inappropriate conduct, complaints, or troubles involving a Babysitter, Rainbow Kids Care may provide relevant information to Clients while carefully protecting personal information.

Article 19 (Handling Problems and Complaints)

If a problem occurs between a Babysitter and a Client, Rainbow Kids Care may hear from both sides and assist in resolving the matter where appropriate.

If Rainbow Kids Care considers it necessary, it may consult or share information with relevant authorities, consumer affairs centers, or other appropriate organizations.

For safety and prevention of future issues, Rainbow Kids Care may share cautionary information or relevant notices while protecting personal information and considering the wishes of the people involved.

Article 20 (Reports to Authorities)

If Rainbow Kids Care believes that a Babysitter with childcare-related qualifications may fall under disqualification grounds or similar serious concerns, Rainbow Kids Care may report necessary information, such as the Babysitter’s name, address, date of birth, registration number, and other relevant details, to the appropriate authorities.

Article 21 (Insurance)

Rainbow Kids Care maintains insurance coverage to the extent it considers necessary.

However, whether insurance applies, and the scope and amount of coverage, will depend on the terms of the insurance policy. Rainbow Kids Care does not guarantee that all damages or losses will be covered.

Article 22 (Suspension or Change of Service)

Rainbow Kids Care may suspend, change, or terminate all or part of the Service due to system maintenance, natural disasters, transportation disruptions, laws or government guidance, or other unavoidable circumstances.

Except in cases of intentional misconduct or gross negligence by Rainbow Kids Care, Rainbow Kids Care will not be liable for damages suffered by Babysitters as a result of such suspension, change, or termination.

Article 23 (Disclaimer and Limitation of Liability)

Rainbow Kids Care does not guarantee that the Service will always operate without interruption, that all information will always be accurate, complete, or up to date, or that all assignments will be confirmed.

Babysitters use the Service and provide childcare services at their own responsibility.

Except in cases of intentional misconduct or gross negligence by Rainbow Kids Care, Rainbow Kids Care will not be liable to Babysitters for damages or losses.

Article 24 (Changes to These Terms)

Rainbow Kids Care may change these Terms when necessary.

If these Terms are changed, Rainbow Kids Care will announce the changes and the effective date by posting them on its website or by another appropriate method.

Article 25 (Severability)

If any part of these Terms is found to be invalid or unenforceable under law, the remaining provisions will continue to be valid and enforceable.

Article 26 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan.

Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court, depending on the subject matter jurisdiction.
