Babysitting Service Agreement

Article 1 (Purpose)

These Terms and Conditions set out the terms under which Rainbow Kids Care ("we", "us") provides babysitting coordination services to Clients, and the conditions under which Babysitters provide childcare services through our platform.

Rainbow Kids Care arranges and coordinates babysitting services in response to Client requests. Babysitters are independent contractors engaged by Rainbow Kids Care and are not employees of Rainbow Kids Care.

Article 2 (Definitions)

In these Terms:

(1) "Service" means the babysitting coordination and booking service provided by Rainbow Kids Care.

(2) "Client" means a person who requests babysitting services.

(3) "Babysitter" means an independent contractor engaged by Rainbow Kids Care to provide childcare services.

(4) "Child" means a minor under the care of the Client.

(5) "Service Agreement" means the agreement formed between the Client and Rainbow Kids Care once a booking is confirmed.

(6) "Service Time" means the time from the start to the end of childcare.

Article 3 (Formation of Agreement)

A Service Agreement is formed when a Client submits a request, Rainbow Kids Care assigns a Babysitter, and the Babysitter accepts the assignment.

We select babysitters based on availability, experience, and suitability. However, we do not guarantee assignment of a specific Babysitter.

Article 4 (Service Details)

The Service may include:

- Child information (age, health condition, allergies, personality)

- Service date and time

- Location

- Childcare details (activities, outings, meals, sleep, etc.)

- Emergency contact information

- Any additional instructions

The Client must provide accurate and complete information necessary for safe childcare.

Article 5 (Verification and Safety)

Before approving a Babysitter to provide childcare services through Rainbow Kids Care, Rainbow Kids Care verifies the Babysitter’s identity, required government notification status, childcare-related qualifications, training status, and submitted documents, conducts an interview, and obtains a declaration confirming that the Babysitter has not received a business suspension order, business closure order, or any similar administrative order.

Rainbow Kids Care also periodically reviews each Babysitter’s registration information, government notification status, childcare-related qualifications, training status, submitted documents, and other information necessary to maintain child safety and legal compliance.

Before the service begins, the Babysitter must provide the Client with the information and present the relevant documents required under the Babysitter Terms of Use, including a valid government-issued identification document, proof of the required government notification, certificates relating to any childcare-related qualifications, the Babysitter’s training status and relevant training completion certificates, and a declaration concerning administrative orders.

The Babysitter must provide the above information and present the relevant documents regardless of whether the Client specifically requests them.

However, Rainbow Kids Care does not guarantee the actions, judgment, or performance of individual Babysitters.

Article 6 (Pre-Service Confirmation)

Before the service begins, the Client and the Babysitter must confirm:

- Location and meeting point

- Child handover process

- Emergency contacts

- Child’s health condition, allergies, medications, special needs, and any other important information

- Childcare details (meals, outings, bedtime, bathing, transportation, etc.)

- Emergency procedures

Article 7 (Child Handover)

The Child must be handed over directly between the Client and the Babysitter.

If another adult will handle handover, this must be agreed in advance.

Article 8 (Childcare Services)

The Babysitter will provide childcare with reasonable care and prioritize the Child’s safety.

The Client must ensure that the environment is safe and provide the necessary items and instructions.

Article 9 (Updates During Service)

If requested by the Client, the Babysitter must provide reasonable updates regarding the Child’s condition during the service where reasonably possible.

Rainbow Kids Care may also assist with communication where necessary.

Article 10 (Post-Service Report)

At the end of the service, the Babysitter must provide the Client with a report regarding the Child’s condition and relevant details such as meals, sleep, and any incidents.

Article 11 (Emergency Response)

In case of illness, injury, or emergency:

- The Babysitter will contact the Client and Rainbow Kids Care immediately  

- Necessary actions may be taken, including calling emergency services  

All related costs (medical, transport, etc.) are the responsibility of the Client.

Rainbow Kids Care may report serious incidents to relevant authorities if required.

Article 12 (Fees and Expenses)

Fees, additional charges, and payment procedures are governed by the User Terms, the Babysitting Policies and Important Fees, and any separate instructions provided by Rainbow Kids Care.

These may include, but are not limited to:

- Babysitting fees
- Same-day extension fees
- Transportation costs
- Late-night taxi or other transportation costs when public transportation is unavailable
- Admission fees for activities or attractions attended by the Babysitter
- Meal costs for the Babysitter when dining together at a restaurant
- Other reasonable expenses incurred in providing the Service

Unless otherwise stated in the applicable cancellation policy or other written policy, unused booking time is non-refundable.

Article 13 (Extensions and Delays)

Extensions are subject to babysitter availability and additional charges.

Late return by the Client will result in additional fees.

Article 14 (Cancellation and Unavailability)

Cancellation terms follow the User Terms.

In rare cases, services may be unavailable due to illness, emergencies, or transport issues.

We will try to arrange a replacement, but this is not guaranteed.

Rainbow Kids Care is not responsible for external losses such as restaurant bookings, tickets, or reservations.

Article 15 (Prohibited Conduct)

Clients must not:

- Request unsafe or inappropriate services  

- Hide important child information  

- Harass or mistreat babysitters  

- Share babysitter personal information without permission  

- Bypass Rainbow Kids Care to make direct arrangements  

- Violate laws or public order  

Article 16 (No Direct Agreements)

Clients and Babysitters must not enter into direct agreements outside Rainbow Kids Care.

Violation may result in account suspension or legal action.

Article 17 (Confidentiality)

Clients, Babysitters, and Rainbow Kids Care must appropriately protect all personal and confidential information obtained through the Service, including information relating to the Child, family members, accommodation, booking details, health conditions, emergency contacts, and other private matters.

Such information may be used only for purposes relating to the Service and may not be disclosed, copied, shared, or used for any unrelated purpose without prior consent, except where required by law or necessary to protect the safety of the Child or another person.

This obligation continues after the completion of the Service.

Article 18 (Photos and Videos)

Photos or videos may not be taken or shared without prior consent.

Article 19 (Dispute Resolution)

In case of disputes, Rainbow Kids Care may assist in resolving issues.

However, we are not a direct party to childcare services and are not responsible unless caused by our gross negligence.

We may consult authorities if necessary.

Article 20 (Information Sharing)

Where necessary for safety, legal compliance, or the proper operation of the Service, Rainbow Kids Care may review and manage feedback, share information relating to serious incidents or complaints, and provide relevant safety information while appropriately protecting personal information.

Article 21 (Personal Information)

Rainbow Kids Care appropriately manages personal information obtained from Clients and Babysitters in accordance with its Privacy Policy and applicable laws.

Personal information is used only for purposes relating to registration, booking, identity verification, service operation, safety management, legal compliance, emergency response, complaint handling, and other purposes described in the Privacy Policy.

Rainbow Kids Care will not disclose personal information except as permitted by law, required for the operation of the Service, or otherwise described in the Privacy Policy.

Article 22 (Insurance)

Rainbow Kids Care maintains insurance coverage where appropriate.

Coverage depends on policy terms and is not guaranteed for all situations.

Article 23 (Limitation of Liability)

We do not guarantee uninterrupted service or specific results.

Except in cases of gross negligence, our liability is limited to the amount paid for the service.

Article 24 (Changes to Terms)

These Terms may be updated when necessary.

Changes will be posted on our website.

Article 25 (Severability)

If any provision is found invalid, the remaining provisions will remain in effect.

Article 26 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan.

Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court.

Article 27 (Good Faith Discussion)

Any issues not covered in these Terms shall be resolved through good faith discussion.
