Welcome to Rainbow Kids Care.

These Terms of Service govern your use of our babysitting coordination and booking service.

1. Service Overview  

Rainbow Kids Care provides coordination and booking services connecting clients with carefully selected babysitters.

Babysitters provide services as independent contractors engaged by Rainbow Kids Care. Rainbow Kids Care facilitates arrangements but does not directly perform childcare.

2. Formation of Agreement  

A service agreement is formed when a client submits a booking request and a babysitter accepts the assignment through Rainbow Kids Care.

3. Client Responsibilities  

Clients agree to:

- Provide accurate and complete information  

- Disclose all relevant child-related information (allergies, medical conditions, etc.)  

- Provide a safe environment  

- Treat babysitters with respect  

Clients remain ultimately responsible for decisions regarding their child(ren)’s care.

4. Nature of Childcare  

Clients acknowledge that childcare may involve minor and unavoidable risks, even under appropriate supervision.

5. Fees and Expenses  

Clients are responsible for:

- Babysitting service fees  

- Transportation costs (train, taxi, etc.)  

- Late-night transportation if public transport is unavailable  

- Admission fees for outings or activities  

- Admission fees, activity expenses, and restaurant-related costs during outings

Clients are not required to provide or cover meals for the babysitter during regular babysitting services.
However, when the babysitter accompanies the child or family to a restaurant or dining venue, the client may be required to cover the babysitter’s meal in accordance with restaurant policies such as one-order-per-person rules.

For services provided outside the babysitter’s regular service area, additional transportation costs may apply.
In cases where significant travel time is required to reach the service location, travel time may be treated as working time and included in the billable service hours. Details will be explained to the client in advance before confirmation.

Certain premium or travel-related services, including Travel Nanny services, are subject to separate service agreements, pricing structures, and operational policies depending on the nature of the booking.

6. Time Policy  

Bookings are treated as fixed time blocks per day.

Unused time is non-refundable and cannot be transferred or carried over.

7. Extensions and Delays  

Extensions are subject to availability and additional charges.

If the client returns later than the agreed time, additional fees will apply.

8. Service Availability  

While we make every effort to fulfill confirmed bookings, babysitter availability cannot be guaranteed in all circumstances.

In case of illness, emergencies, or transportation issues, we will attempt to arrange a replacement but cannot guarantee one.

Rainbow Kids Care is not responsible for any external arrangements, including reservations or tickets.

9. Cancellation Policy  

- More than 7 days: Full refund  

- 7 days to 48 hours: 50%  

- Within 48 hours: 100%  

10. Service Termination  

Services may be terminated immediately without refund if:

- The environment is unsafe  

- Inappropriate or unreasonable requests are made  

11. Non-Circumvention  

Clients may not directly hire or engage babysitters introduced through Rainbow Kids Care outside the platform.

12. Dispute Handling  

Rainbow Kids Care may assist in resolving disputes but is not a contracting party responsible for childcare outcomes.

13. Information Sharing  

Where necessary for safety, we may share relevant information with users while respecting privacy.

14. Liability  

Rainbow Kids Care does not guarantee babysitter performance.

To the extent permitted by law, liability is limited to the total fees paid.

15. Emergency  

Babysitters may take necessary action in emergencies. All related costs are the responsibility of the client.

16. Insurance  

Clients are encouraged to obtain travel insurance.

17. Force Majeure  

We are not responsible for disruptions caused by events beyond our control.

18. Governing Law and Jurisdiction  

These Terms are governed by the laws of Japan.

Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court.
